Is a License Required In Texas To Sell CBD Products?

As prescription drugs, CBD products have FDA approval! Federal regulations say CBD cannot be included in foods, cosmetics, or nutritional supplements. However, the state health department of Texas certified the sale and purchase of cannabis as legal in 2019.

According to the legal definition of hemp under State House Bill 1325, which says:

“Hemp refers to the Cannabis sativa L. plant or any part of it, including the seeds, acids, and isomers, whether it is growing or not, and has a tetrahydrocannabinol (THC) content of <0.3% or less by dry weight.”

Hemp is now permitted for purchase and sale under the Texas Controlled Substance Act because it is removed from the definition of marijuana. But a query pops into my head! In Texas, do you require a license to sell CBD products?

This blog will provide you with comprehensive information about the licensing of CBD products. Let’s get started!

Do You Need A License To Start The CBD Business?

CBD business is reaching a new height of success with each passing day in the USA. It’s estimated that consumer sales in this sector will reach around $1.8 billion in 2022.

We are witnessing the emergence of new businesses in numerous US states, including Texas, as the demand for CBD continues to rise.

And when we are discussing the licensing issue regarding selling CBD products. Yes, a license is required to sell cannabis products in Texas. The Department of State Health Services must receive registration applications from those who want to launch a company selling CBD products.

CBD Products Licensing Process

Retailers and distributors of CBD products can apply for registration and license on an online platform provided by the Department of State Health Services. Then, click the "View PDF Summary Report" button to acquire a copy you can print and save.

Role of the Department of State Health Services

State Health Services Department Texas has the power to control the sale of CBD products, but the state does not forbid their sale. The following jobs are also specified in House Bill 1325:

  • For the start of the manufacturing licensing program for CBD products for consumption.
  • It plays a part in developing a registration procedure for merchants selling CBD products.
  • Assisting with the testing of CBD products that are for sale.

An Important Message For Sellers

If you own a CBD business and want to offer products like CBD Oil, cosmetics, and other CBD-infused things, you must ensure that the suppliers are authorized and have third-party testing facilities.

You could get into trouble if you don`t confirm that the cannabis products are made from hemp and not marijuana. Following FDA standards, marijuana cannot be sold since it has a greater THC level.

I hope that this guide has assisted you in gaining a thorough understanding of Texas` licensing requirements for CBD products, the application process, and the Department of State Health Services` responsibilities.
